Legal Weight Limits
Georgia allows the standard 80,000 lbs gross (five axles) on interstates, with 20,340 lbs per single axle and 34,000 lbs per tandem (Georgia’s single-axle limit is slightly odd at 20,340, which is the 18,000 lb base plus a 13% tolerance, but effectively 20k).
Georgia law permits a 5% variance in weight on non-interstate highways for vehicles carrying certain commodities (forest products, poultry, cotton, feed, minerals, aggregates, solid waste, fresh concrete, and farm products moving from the farm) within a set radius of origin, and a 10% variance within 150 miles for certain agricultural, forest and recovered-material loads on certified equipment outside nonattainment areas. This means those loads may run to ~84,000 lbs (or ~88,000 lbs under the 10% variance) on state routes, while 80k remains max on interstates, since federal limits apply, and trucks hauling other freight get no variance.
Additionally, Georgia issues permits for heavier non-divisible loads only: e.g., standard annual permits allow up to 100,000 lbs and single-trip permits go higher based on axle count, but divisible loads are not allowed under a permit. Axle limits still generally cap at 20k (single) and 34k (tandem) on interstates (40,680 lbs tandem on non-interstate routes), and lift axles cannot be counted toward the maximum gross weight. The bridge formula is enforced for spreading weight.
Summarily, without permits or special exemptions, exceeding 80k (or axle limits) triggers overweight enforcement, and the commodity variances are the only percentage allowance.
Fine Structure
Georgia’s overweight fines are charged per pound above the allowed limit, with the rate increasing as the total weight increases. O.C.G.A. § 32-6-27, enforced by the Georgia Department of Public Safety, sets it out as follows:
- Gross weight up to 93,000 lbs: 5¢ per lb for all excess weight over the allowed limit. That’s $50 for 1,000 lbs over – there is no free tolerance band, every pound over the limit is assessed.
- Gross weight of 93,001 – 99,999 lbs: 10¢ per lb for all excess weight. At 95,000 lbs on a normal 5-axle (15,000 over), that’s $1,500.
- Single axle overloads: 5¢ per lb up to 25,520 lbs on the axle, 10¢ per lb from 25,521 to 27,449 lbs, and 15¢ per lb at 27,450 lbs or more.
- Tandem axle overloads: 5¢ per lb up to 51,000 lbs on the tandem, 10¢ per lb from 51,001 to 54,879 lbs, and 15¢ per lb at 54,880 lbs or more.
- 100,000 lbs or more: If the gross weight is 100,000 lbs or more (which is 20k over on a normal 5-axle), Georgia law sets a higher fine rate of 15¢ per pound for all excess weight. So once you hit 100k, you pay $0.15 per lb for every pound over the legal limit. For example, at 110,000 lbs (30k over), you’d owe about $4,500 just in per-pound fines (30,000 × $0.15).
Practically, for a typical violation: say a truck 8,000 lbs over (88k on 5 axles without permit). The fine is computed as: 5¢×8,000 = $400. Gross and axle overages are calculated separately, but when both are exceeded the state collects only the larger of the two amounts. Georgia does not set a separate minimum penalty; the assessment is due within 30 days, and unpaid assessments can lead to vehicle seizure and registration suspension – with a 60-day suspension for a second unpaid violation within two years. If an overweight is on a posted bridge, a separate schedule applies: 5¢ per lb up to 7,500 lbs over the posting, 10¢ per lb from 7,501 to 14,999 lbs over, and 15¢ per lb at 15,000 lbs or more over.
Enforcement Methods
Georgia’s weight enforcement is handled by the Commercial Vehicle Enforcement (CVE) division of the Georgia DPS, known until July 1, 2025 as the Motor Carrier Compliance Division (MCCD) and formerly under GDOT. Georgia operates largescale weigh stations on interstates – e.g., on I-75 at the Florida line, on I-95, I-20, I-85, etc. These stations use weigh-in-motion and PrePass systems. The sign “Trucks Weighed At Speed – Do Not Stop if Cleared” is common: compliant trucks often get green lights to bypass. Suspected overweight trucks are directed to the static scales.
CVE officers also run random roadside weight checks using portable scales on highways known for overweight issues (for example, routes around the Port of Savannah or near Atlanta’s warehouses). Georgia’s enforcement includes some unique tactics: the state has been known to set up “weigh checkpoints” on state highways that parallel interstates, to catch trucks avoiding interstate scales. Additionally, Georgia has inspection teams that can enforce at carrier terminals (ensuring carriers aren’t sending out overweight loads illegally).
If a truck is found overweight, Georgia typically requires it to park until it can be brought into compliance (they might allow it to creep to a nearby yard). Law enforcement can also escort the truck to a safer location to offload, if needed.
Georgia’s scale houses are quite active. Many incorporate technology to automatically screen credentials and USDOT history. The state’s fine rates (a flat nickel per pound at ordinary overages) indicate an approach of steady, predictable penalties, but once trucks really push past the legal limit, enforcement is serious – particularly above 93k and 100k where the per-pound rate jumps. Georgia’s per-pound assessment is civil, but separate charges can apply in blatant cases (e.g., if a truck is dangerously overweight and causes damage or refuses to stop, there could be misdemeanor consequences). The State Patrol and local police sometimes assist, especially if overweight trucks travel on county roads (like quarry or timber trucks – Georgia’s rural areas see those).
All in all, Georgia employs manned interstate weigh stations with WIM tech, CVE roving units with portable scales, and a graduated fine system. Since every pound over is assessed, truckers have reason to avoid being even a few hundred pounds heavy in Georgia, and they absolutely avoid being tens of thousands over, as the cost and potential to be taken out of service are high. Enforcement focuses on preserving highways (like I-16, I-95 coastal corridor, and Atlanta’s interstates) and preventing bridge strain, given some older bridges in rural areas.
